ARBITRATION AND COMMERCIAL COURTS LITIGATION –
The Arbitration and Conciliation Act, 1996, along with the Commercial Courts Act, 2016, has been at the forefront of commercial disputes, empowering District Courts as Commercial Courts and High Courts as Commercial Appellate Courts.

Our team concentrates on the key issues regarding the Court’s authority to refer matters for Arbitration, the execution of applications for interim protections prior to or during arbitration proceedings, the recognition and enforcement of arbitration awards, the Arbitration Tribunal’s authority to rule on its jurisdiction, and the distinction between the Seat and Venue of Arbitration.

COMMERCIAL LITIGATION –WRIT JURISDICTION
Articles 32 and 226 of the Indian Constitution grant writ jurisdiction to the Supreme Court and High Courts, respectively, for the enforcement and protection of an individual’s fundamental rights. These directives, orders, or writs may be issued to uphold fundamental rights or for other purposes.

Our team has extensive experience in handling a wide variety of commercial, corporate and regulatory disputes and both in filing and defending writ petitions before the Supreme Court of India and High Courts throughout the country, particularly in handling Public Interest Litigation, a subset of writ litigation that frequently develops into a series of cases involving broader and more significant legal matters.

We provide our clients with guidance on how to respond to arbitrary actions taken by State authorities, from developing strategies and communicating with State authorities to filing writ petitions and representing them before the Supreme Court and various High Courts.

The team has provided legal advice and support to entities including the Income Tax Department, Punjab State Warehousing Corporation (PSWC), Punjab State Co-op Supply and Marketing Federation Limited (MARKFED), UNIPRO Agro Limited, and several other governmental and private organizations engaged in commercial litigation.
