EMPLOYMENT LITIGATION – SERVICE AND LABOUR

SERVICE
The Constitution of India is the cornerstone of individual rights and liberties, and provides the basic framework within which all laws in India, including laws relating to employment, must operate. The Constitution guarantees certain fundamental rights to individuals such as the right to life, privacy, equality before the law and prohibition of discrimination in public education and employment on the basis of religion, race, gender, caste, health conditions, and other legally protected status. In addition to fundamental rights, the Constitution also envisages certain ‘directive principles’ which serve as a guide to the legislature towards fulfilling social and economic goals.

It is crucial to recognize that numerous labor laws in India have been established with a focus on worker emancipation. This includes legislation pertaining to factories, mines, plantations, shops, and commercial establishments, as well as laws concerning wage payments, trade union regulations, social security provisions, and industrial safety and hygiene.
